By visiting our site and/or purchasing something from Uforia Sauna & Cold Plunge, you engage in our “Services” and, thereby, agree to be bound by the following terms and conditions (“Terms & Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms & Conditions apply to all users of the site, including and without limitation, users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Please read these Terms & Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the Store and/or Site or use any services provided by Uforia Sauna & Cold Plunge and/or Uforia Wellness, LP. If these Terms & Conditions are considered an offer, acceptance is expressly limited to these Terms & Conditions. 

Any new features or tools which are added to the current site and/or store shall also be subject to these Terms & Conditions. We reserve the right to update, change or replace all or any part of these Terms & Conditions by posting updates and/or changes to our website. SECTION I - ONLINE STORE TERMS

By agreeing to these Terms & Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site. You may not use any of our products or services for any illegal or unauthorized purpose nor may you, in the use of the site and/or store, violate any laws in your jurisdiction (including but not limited to copyright laws). 

You must not transmit any worms or viruses or any code of a destructive nature on the site and/or store at any time. A breach or violation of any of the Terms & Conditions will result in an immediate termination of your access and resulting agreements for products, components or services from Uforia Sauna & Cold Plunge as well as Uforia Wellness, LP.

We reserve the right to refuse access to anyone for any reason at any time in accordance to these Terms & Conditions. 

You understand that your content (not including credit card information), may be transferred unencrypted and involve

Credit card information is always encrypted during transfer over networks using secure socket layer technology (SSL) and stored with AES-256 encryption. 

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Store and/or Site; use of the Store and/or Site; access to the Store and/or Site or any contact on the Store and/or Site through which the products and/or services are provided, without the express written permission Uforia Sauna & Cold Plunge and/or Uforia Wellness, LP.

We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products, components and/or services that we offer. We do not warrant that the quality of any products, components and/or services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address and/or the phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made on the Uforia Sauna & Cold Plunge store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Uforia Sauna & Cold Plunge and/or Uforia Wellness, LP, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Store and/or Site or any products procured using the store and/or site, or for any other claim related in any way to your use of the store and/or site or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Store and/or Site or any content (or product) posted, transmitted, or otherwise made available via the Store and/or Site, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Uforia Wellness, LP and Uforia Sauna & Cold Plunge and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

SECTION XV - SEVERABILITY

In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Condition, such determination shall not affect the validity and enforceability of any other remaining provisions. 

SECTION XVI - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

These Terms & Conditions are effective unless and until terminated by either you or us. You may terminate these Terms & Conditions at any time by notifying us that you no longer wish to use our services, or when you cease using our site. 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms & Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Store and/or Site (or any part thereof). 

 SECTION XVII - ENTIRE AGREEMENT

 The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. 

These Terms & Conditions and any policies or operating rules posted by us on this site or in respect to the Store and/or Site constitutes the entire agreement and understanding between you and us and governs your use of the Store and/or Site, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms & Conditions). 

Any ambiguities in the interpretation of these Terms & Conditions shall not be construed against the drafting party.

Placing an Order

There are two ways to order products, components and services from Uforia Sauna & Cold Plunge. First, one can visit our Showroom and select the item(s) they are interested in, click the "Add to Cart" button for all the items they wish to purchase. Once they have selected all of their desired items, they click on the Shopping Cart in the upper right corner of the Header and view their cart. Once satisfied with the items they have selected, they can move to Check Out and purchase their item(s) using one of the available payment options listed here and above:

Delivery

Orders are delivered by professional expediters and delivery services like the USPS, FedEx, UPS, DHL. Delivery will be to safe location off the street. Delivery time from manufacture completion varies depending on the product, destination and customizations. Delivery will be confirmed after the order is verified and manufacturing has been scheduled.

Returns & Refunds

• 30-Day Money Back Guarantee: We offer a 30-day money back guarantee on all sauna purchases. If you are not completely satisfied with your sauna, Infrared cabin, hybrid sauna cabin and/or cold plunge tub, you may return it within 30 days of delivery for a full refund, minus any shipping and restocking costs.

• Per our “30 Day Money Back Guarantee Policy” returns will be accepted within 30 days of product receipt. Shipping charges on returns shall be the responsibility of the customer and all returned items must be returned in “new” or “like new” condition, in an unopened, undamaged original manufacturer’s packaging, and with all original product manuals. After the product is received, inspected and verified to be in “like new” condition (not used), a full refund will be provided on the product purchase price minus any original and return shipping charges and minus a 25% restocking charge. For products sold with a “Free or Discounted Shipping Promotion”, the actual freight cost to originally ship the product will be deducted from your refund.

• Order Cancellation Policy: If an order is canceled prior to shipment, the customer will incur a $250 cancellation fee, whether she/he has paid a deposit or in full. Note that we consider your product to be “shipped” when a Bill of Lading and tracking number have been generated for a freight carrier. After products are considered shipped, cancellations are treated as returns as described below. In addition, there is a 50% cancellation fee to help cover production cost losses for all traditional sauna, infrared cabin, hybrid sauna cabins and/or cold plunge tub orders as all traditional saunas, infrared cabin, hybrid sauna cabins and/or cold plunge tub are or may be custom made at time of order.

• Return Eligibility: To be eligible for a return, the sauna, infrared cabin, hybrid sauna cabin and/or cold plunge tub must be unused, in its original condition, and in the original packaging. Any saunas, infrared cabins, hybrid sauna cabins and/or cold plunges that have been used or are not in resalable condition may not be eligible for a refund.

• Return Process: To initiate a return, please contact our team within 30 days of receiving your sauna, infrared cabin, hybrid sauna cabin, and/or cold plunge tub. We will provide you with a Uforia Return Authorization Number (URAN) and instructions for returning the item. No item will be accepted for return unless it has a URAN.

• Return Shipping: Customers are responsible for return shipping costs unless the return is due to a manufacturing defect or shipping damage. We recommend using a trackable shipping service to ensure your return is received.

• Refund Process: Once we receive and inspect the returned sauna, we will process your refund within 30 business days. Refunds will be issued to the original method of payment.

• Exchanges: If you would like to exchange your sauna for a different model, please contact our customer service team to arrange for an exchange. Additional shipping fees will apply to the returned item(s) and delivery of new items.

• Damaged or Defective Items: If your sauna arrives damaged, please contact us immediately. For any products not properly functioning, we will assist you with troubleshooting and will replace the item entirely if we cannot fix them. Replacements are subject to current stock availability and you may experience delays. We will arrange for a replacement to be sent to you at no additional cost.

• Non-Returnable Items: Customized or personalized saunas, as well as accessories that have been used or opened, may not be eligible for return unless they are damaged or defective.

• Refusal of Returns: We reserve the right to refuse returns that do not meet our return policy criteria or if the return is initiated after the 30-day period.
